الملخص

ملخص: إن الإجرام المنظم له أثره على قواعد التجريم والعقاب، لكن ما مدى أثره ؟، وهذا مما دعا في هذه الدراسة إلى البحث في أثر الإجرام المنظم على قواعد التجريم من حيث تجريم الأشخاص وصور التجريم، والتطرق إلى أثر الإجرام المنظم على قواعد العقاب من خلال تناول عقوبة الانتماء للإجرام المنظم وعقوبة ممارسة أنشطة الإجرام المنظم. ومن أهداف الدراسة البحث في الوصف الجنائي لأنشطة الإجرام المنظم وعُقوبتها، وهذا اعتمادًا على المنهج التحليلي في نقد النصوص والمنهج الوصفي في البيان والمنهج المقارن للقواعد والأحكام، ومن أبرز النتائج المتوصل إليها أن الإجرامُ المنظّمُ أثّرَ على قواعد التّجريم والعقاب التي وُضِعت خصّيصًا لأنشطة الإجرام المنظم، وتشريعات وطنية منها التشريع الجزائري نصت على الإجرام المنظّم كجريمةٍ قائمةٍ بذاتها تجسيدًا لما أرسته قواعد القانون الدولي الجنائي، وجعلته ظرفًا مشددًا لأنشطته، ومن أهم التوصيات تعديل قواعد التّجريم والعقاب في اتفاقية الأمم المتحدة لمكافحة الجريمة المنظّمة لتكون أكثر فاعلية. Abstract: Organized crime has an impact on the rules of criminalization and punishment, but to what extent is its impact ?, This is what called for this study to investigate the impact of organized crime on the rules of criminalization in terms of criminalizing people and forms of criminalization, and to address the impact of organized crime on the rules of punishment by addressing the punishment Belonging to organized crime and the penalty for engaging in organized crime activities. One of the objectives of the study is to research the criminal description of organized crime activities and their punishment, based on the analytical approach in criticizing texts, the descriptive approach in the statement, and the comparative approach to rules and provisions. Among the most prominent results reached is that organized crime affected the rules of criminalization and punishment that were developed specifically for organized crime activities, and legislation. National legislation, including Algerian legislation, stipulates organized crime as a stand-alone crime, embodying what has been established by the rules of international criminal law, and making it an aggravating circumstance for its activities. One of the most important recommendations is to amend the rules of criminalization and punishment in the United Nations Convention against Organized Crime to be more effective.
