التكريس الجنائي للحماية الدستورية للحق في السلامة الجسدية

الملخص
نظرا لأهمية وقدسية حق الإنسان في سلامته الجسدية لإرتباطها الوثيق بالحق في الحياة، حرصت الدولة الجزائرية على حماية وتكريس هذا الحق بعديد الوسائل والطرق، ليعد أهم هذه الوسائل المستعملة الوسيلة الدستورية أين تم دسترة حق الإنسان في السلامة الجسدية في جميع دساتير الجزائر المتعاقبة وكل تعديلاتها، ليبعث بذلك المؤسس الدستوري الجزائري الطمأنينة في قلوب المواطنين من جهة، ويضمن من جهة أخرى قيام سلطات الدولة وفي مقدمتهم السلطة لتشريعية التي تلتزم وفقا لمبدأ سمو الدستور بعدم الإنتقاص من هذا الحق بل يقع على عاتقها كفالته. وهو الأمر الذي أثار لدينا الفضول للبحث عن كيفية تجسيد المشرع الجنائي لهذا الحق وتفعيله على أرض الواقع، لنصل في الأخير إلى نتيجة مفادها أن المشرع الجنائي الجزائري كان سبقا في حماية لحق الإنسان في سلامته الجسدية من خلال ما أصدره من تشريعات جنائية تتماشى وهذا التوجه الدستوري وتكفل وتواجه كل اشكال المساس بهذا الحق. Due to the importance and sanctity of the human right to physical safety, given its close connection to the right to life, the Algerian state has been keen on protecting and enshrining this right through various means and methods. One of the most important of these methods is the constitutional means, where the human right to physical safety has been enshrined in all successive Algerian constitutions and their amendments. This constitutional guarantee instills confidence in the hearts of citizens on one hand, and ensures, on the other hand, that the state authorities, particularly the legislative authority, uphold, in accordance with the principle of the supremacy of the constitution, the commitment not to diminish this right, but rather to ensure its protection. This curiosity led us to explore how the criminal legislator embodies and activates this right in reality, Ultimmately, we arrived at the conclusion That the Algerian criminal legislator has been proactive in protecting the human right to physical safety through the issuance of criminal legislation That aligns with This constitutionl direction, ensuring he safeguarding and addressing of any violations of this right
