الملخص

يؤدي القيد في السجل العقاري وظيفة الاعتراف بالملكية، واحاطتها بالحجية اللازمة في تبريرها، وتوفير القوة الثبوتية المطلقة لقيود السجل العقاري، ونفاذها في حق الغير، الذي يسود نظام السجل العقاري، ويمنع الاعتداد بأي حق عيني عقاري مالم يكن هذا الحق مسجلا في الصحيفة العقارية، ان هذه الدراسة تتناول بشكل مفصل مفهوم القيد في السجل العقاري، ووسائل تحرير الملكية، أنواع القيد (الاحتياطي والنهائي)، وبعض صور ونماذج القيد الاحتياطي، ومدى تحقيق مبدأ التوازن بين ضوابط تحرير الملكية، وضرورة التقييد. Registration in the real estate registry performs the function of recognizing ownership, providing it with the necessary authority to justify it, providing absolute probative force for the real estate registry entries, and their enforcement against third parties, which prevails in the real estate registry system and prevents infringement of any real estate right, unless this right is registered in the real estate newspaper. This study deals in detail with the concept of registration in the real estate registry, the means of releasing ownership, types of registration (reserve and final), some forms and models of reserve registration, and how to achieve the principle of balance between the controls for releasing ownership and the necessity of restriction. key words:
