إمكانية منح الشخصية القانونية للروبوت

الملخص
أحدثت التطورات الالكترونية والتكنولوجيا ثورة كبيرة في كل المجالات المختلفة للحياة ،حيث انعكست عليها مثيرة عدة تحديات واشكاليات خاصة في بعض المجالات منها المجال القانوني ، فبعد التطورات السريعة للتكنولوجيا وصلت الاختراعات إلى صنع روبوتات ذكية عن طريق وضع خوارزميات مبرمجة بذلك هذا الكيان الآلي على التصرف بذكاء يحاكي ذكاء الإنسان الطبيعي. الشيء الذي أفرز لنا إشكال في الحقل القانوني في الشق المتعلق بمسؤولية هذا الكيان في حالة تسببه لضرر خاصة واننا عهدنا في القواعد الكلاسيكية للمسؤولية أن مسبب الضرر لا يمكن ان يكون إلا شخص معنوي أو طبيعي ،والشخص الآلي هو آلة صنعها الإنسان أصبح ينافس الإنسان في بعض مهامه و أعماله. غير أنه لا يملك شخصية قانونية لأنه لا يملك مقومات ومواصفات وشروط اكتسابها كشخص طبيعي أو معنوي مما يجعلنا أمام إشكال قانوني كبير خاصة في الحالات التي تحتاج لقيام مسؤولية قانونية نظراً لوجود خطأ سبب ضرراً موجباً للتعويض. Electronic developments and technology have brought about a major revolution in all different fields of life, as they have been reflected in, raising several challenges and problems, especially in some fields, including the legal field. After the rapid developments of technology, inventions have led to the creation of intelligent robots by developing programmed algorithms, thereby enabling this automated entity to act intelligently, simulating... Natural human intelligence. The thing that created a problem for us in the legal field is the aspect related to the responsibility of this entity in the event that it causes damage, especially since we know in the classical rules of responsibility that the cause of the damage can only be a legal or natural person, and the automated person is a machine made by humans that has become a competitor to humans in some ways. His duties and works. However, he does not have a legal personality because he does not have the capabilities, specifications, and conditions for acquiring it as a natural or legal person, which leaves us facing a major legal problem, especially in cases that require legal liability due to the existence of an error that caused damage requiring compensation.
