الوقف العلاجي المبتكر: وقف الدواء للمريض المزمن أنموذجاً The Innovated Therapeutic Endowment: The Chronic Illnesses’ Treatment Endowment As An Example

الملخص

عالج هذا البحث فكرة مبتكرة في نطاق الوقف العلاجي تقوم على تأمين الدواء للمريض المزمن بشكل دوري من خلال إنشاء وقف لهذا الغرض تحديدًا ، وقد تطرق إلى بيان مفهوم الوقف العلاجي المبتكر ، ومشروعيته ، ومقوماته ، بالإضافة إلى طرق تمويله واستثماره ومصارفه . واعتمد على كل من المنهج الاستقرائي والتحليلي والوصفي . وتوصّل إلى عدّة نتائج من أهمها؛ أن هذا الوقف مشروع ، وأن استثمار أعيانه يجب أن تتم وفق ضوابط شرعية محدّدة، كما أن مصارفه تكون لصالح كل شخص توفرت فيه صفة المريض المزمن العاجز عن تأمين أدويته بسبب فقره؛ كمرضى السكر وضغط الدم والقلب والكلى ونحو ذلك. وأوصى الباحثين في فقه الوقف بإعداد الدراسات الوقفية التي تثري فكرة الابتكار الوقفي. Abstract: This research investigated an innovated idea within the scope of therapeutic endowment that is based on the constant provision of medicine to those who suffer from chronic illnesses; this is achieved by creating an endowment for this exact reason. The researchers followed an inductive, analytical and descriptive research methodology. The research reached several conclusions, some of which are the following: The researchers proved the legitimacy of this endowment, and stated that the investment of the endowment assets should be conducted according to specific sharia-based regulations, and that the discharges should be given to anyone that qualifies as a person with a chronic illness and is unable to afford treatment because of his/her poverty. The research encouraged scholars specialized in the Fiqh of endowment to conduct more endowment-related studies in order to enrich the literature and spread the idea of innovative endowment.
