الاجتهاد التنزيلي في القضايا المعاصرة وآلياته Jurisprudence In Contemporary Cases And Its Mechanisms

الملخص
يدرس الـمقال الاجتهاد التّنزيلي في القضايا المعاصرة وآلياته، انطلاقا من بيان مفهومه ومفهوم الاجتهاد في تحقيق المناط الّذي تكلّم عنه العلماء المتقدّمون، معرّجا على بيان الفرق بينه وبين الاجتهاد الاستنباطي، الّذي يكمن بشكل أساسيّ في أنّ الاجتهاد الاستنباطي يستنطق فيه المجتهد النصّ الشّرعي من خلال التعامل مع الألفاظ المشكّلة له معنى وقصدا، بينما في الاجتهاد التنزيلي يعمل المجتهد فيه على البحث في مناطات الحكم المجرّد في الواقع، باستخدام آليّات التّنزيل المتمثّلة في آلية اللّغة والعرف والحسّ (النّظر، السّمع، الشمّ، الذّوق، اللّمس)، وهناك آليات أخرى عقليّة وأخرى طبيعيّة، أمّا العقليّة فتتمثّل في اعتبار المصالح والمفاسد، واعتبار قواعد التّرجيح بين المصالح والمفاسد، وفقه الواقع، واعتبار مآلات الأحكام والتصرّفات، وأمّا الطّبيعيّة فتتمثّل في اعتبار أهل الخبرة، سواء كانت خبرة تتعلّق بحال النّاس وأعرافهم وتقاليدهم، أم خبرة علميّة تتعلّق بضبط مختلف العلوم والمعارف المتعلّقة بمختلف مجالات الحياة، وكذلك اعتبار الاكتشافات العلميّة (التّقنية الحديثة) في التّنزيل نظرا للتطوّر السّريع لمختلف العلوم والمعارف الّتي تجعل قضايا العصر سريعة التّغيّر، ممّا يجعل مناط حكمها قابلا للتغيّر في كلّ حين، فكان لزاما على المجتهد أن يكون على دراية تامّة لِما وصلت إليه التّقنية الحديثة في المسألة المبحوثة، ولعلّ العلوم الإنسانيّة والاجتماعيّة هي المدخل لفهم حركة المجتمع وتطوّره؛ ممّا يُعين في ترتيب المصالح والمفاسد المتوخّاة لقضايا العصر. The article examines the downright jurisprudence in contemporary issues and its mechanisms, based on the statement of its concept and the concept of diligence in achieving the point(elmanate) which the advanced scientists have talked about, lashing out on the difference between it and deductive jurisprudence, Which lies mainly in the fact that the hard-editorialist interprets the legitimate text by dealing with the problematic words has meaning and purpose, while in the hard-editorialist, the hard-editorialist works to research the points of abstract judgement in reality, using the download mechanisms of language, custom and sense (sight, hearing, smell, taste, Touch), There are other mental and natural mechanisms, while the mentality is to consider interests and corruptions, and consider the rules of weighting between interests and corrupters, jurisprudence of reality, and consider the fate of judgements and actions, or the natural is to consider the experienced people, whether their experience related to the situation of people and their customs and traditions. Or scientific experience related to the control of various sciences and knowledge related to different areas of life, as well as considering scientific discoveries (modern technology) in download due to the rapid development of various sciences and knowledge that make the issues of the age rapidly changing, making the subject of its rule subject to change at all times, It was necessary for the diligent to be fully aware of the modern technology in the matter under consideration, and perhaps the humanities and social sciences are the gateway to understanding the movement and development of society; This assists in arranging the interests and corruptions of today's issues.
