البعد المقاصدي في فتاوى الشيخ أحمد حماني

الملخص
الشيخ أحمد حمّاني من أبرز علماء الجزائر في العصر الحديث، ومن كبار المفتين العارفين بالمذهب المالكي، بدأ حياته العلمية في مسقط رأسه بولاية جيجل، ثم انتقل إلى قسنطينة حيث أكمل دراسته على يدي العلامة عبد الحميد ابن باديس، ثم ارتحل إلى تونس فواصل تعليمه على أيدي نخبة من علمائها إلى أن حصل على شهادات عليا. عاد إلى الجزائر حيث انخرط في صفوف جمعية العلماء المسلمين الجزائريين ودرّس في مدارسها، وكتب في صحفها وجرائدها إلى قيام ثورة التحرير فانخرط في صفوف المجاهدين إلى أن ألقي عليه القبض وسجن إلى حين الاستقلال. درّس الشيخ حمّاني بعد الاستقلال في جامعة الجزائر، كما تقّلد رئاسة المجلس الإسلامي الأعلى، ورئاسة جمعية العلماء، وألّف عدّة كتب، منها موسوعته في الفتوى التي كان يجيب فيها على أسئلة السّائلين من داخل البلد وخارجه حيث تميّزت بالتأصيل والتقعيد والتقص Sheikh Ahmed Hammani is one of the prominent scholars of Algeria in the modern era and one of the leading knowledgeable scholars in the Maliki school of thought. He began his academic life in his hometown of Jijel, then moved to Constantine where he completed his studies under the guidance of the eminent scholar Abdul Hamid ibn Badis. He later traveled to Tunisia to continue his education under the tutelage of a select group of its scholars until he obtained advanced degrees. Upon his return to Algeria, he joined the ranks of the Algerian Muslim Scholars Association and taught in its schools, contributing articles to its newspapers until the outbreak of the liberation revolution, during which he joined the ranks of the mujahideen until his arrest and imprisonment until independence. Sheikh Hammani taught at the University of Algiers after independence, also serving as the head of the Higher Islamic Council and the Algerian Scholars Association. He authored several books, including his encyclopedia on issuing religious edicts (fatwas), in which he addressed questions from both within and outside the country, characterized by thoroughness, consolidation, and precision. One of its prominent features is its methodological dimension, where Sheikh Hammani elucidated its causes and objectives. This study aims to highlight this characteristic through an analysis of his fatwas.يد، ومن أبرز معالمها البُعْدُ المقاصدي، حيث كان الشيخ حمّاني يبيّن عللها ومقاصدها؛ لذا تأتي هذه الدراسة لبيان هذه الخاصّية من خلال استقراء فتاويه.
