الجرد العام كآلية إدارية لحماية العقار الغابي

الملخص

تتكفل إدارة الغابات لغرض حماية العقار الغابي بجرده بالتنسيق مع مصالح إدارة أملاك الدولة باعتبار الاولى مسيرة والثانية مالكة ، وذلك بتسجيل وصفي وتقييمي يقوم على إعداد جرد عام للعقارات الغابية على اختلاف أنواعها (غابة ،غيضة، أراضي ذات طابع غابي، أراضي حلفاوية…) حسب الأحكام القانونية والتنظيمية المعمول بها، مستهدفا ضمان حماية العقارات الغابية لما لها من خصوصية وطنية والحرص على استعمالها وفق الأهداف المسطرة لها ، لذلك فان العقارات الغابية الوطنية تخضع لعملية الجرد وفقا للقانون رقم 90/30 المؤرخ في 01/12/1990 المتضمن قانون الأملاك الوطنية المعدل والمتمم لاسيما أحكام المادة 21 و 25 منه، وكذا المرسوم رقم 91/455 المؤرخ في 23/11/1991 المحدد لشروط جرد الأملاك الوطنية. For the purpose of protecting the forest property, the Forest Department is responsible for its inventory, in coordination with the state property management departments, with the former being the occupier and the latter the owner, through a descriptive and evaluative registration based on the preparation of a general inventory of the forest property of all types (forest, forest, lands of a forest nature, allied lands...) in accordance with the provisions. The applicable legal and regulatory framework aims to ensure the protection of forest properties due to their national specificity and to ensure that they are used according to the objectives set for them. Therefore, national forest properties are subject to the inventory process in accordance with Law No. 90/30 of 12/01/1990, which includes the amended and supplemented National Property Law. Especially the provisions of Articles 21 and 25 thereof, as well as Decree No. 91/455 of 11/23/1991 specifying the conditions for the inventory of national property.
