الملخص
من أجل حسن تسيير الملكية المشتركة و الحفاظ على النمط الجماعي للسكن و الذي يقتضي تحسين صورة الملكية المشتركة التي عرفت تدهورا كبيرا من قبل شاغليها ، فقد استحدث المشرع الجزائري من خلال قانون 11/04 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية إلزامية وضع نظام للملكية المشتركة في مجال الترقية العقارية و خاصة في عقد البيع على التصاميم ، إذ جعله وثيقة واجبة التحرير قبل إبرام عقد البيع على التصاميم ، حيث ألزم المرقي العقاري بإعداده مطابقا للنموذج المحدد في المرسوم 14/99 ، بالإضافة إلى إلزامية تسليمه لكل مقتني . Abstract: In order to properly manage joint ownership and preserve the collective style of housing, which requires improving the image of joint ownership, which has witnessed a significant deterioration by its occupants, the Algerian legislator has introduced through Law 11/04 that defines the rules that regulate the activity of real estate promotion. It is obligatory to establish a system of joint ownership in the field of real estate promotion, especially in the sales contract on plans, as it made it a document that must be edited before concluding the sales contract on plans, whereby the real estate developer was obligated to prepare it in accordance with the model specified in Decree 14/99, in addition to the obligation to hand it over. for eac
