الملخص
تقوم مسؤولية الإدارة دون خطأ لمرفق الشرطة على أساس المخاطر وتطبق في حالة حصول ضرر عن الأعمال التي يقوم بها مرفق الأمن باستعمال الأسلحة والآلات التي تشكل مخاطر استثنائية للأفراد، والمسؤولية على أساس الاخلال بمبدأ المساواة أمام الأعباء العامة وتطبيقها في حالة امتناع الإدارة عن تنفيذ الأحكام القضائية، أو القرارات التنظيمية. وظهرت المسؤولية الإدارية بدون خطأ كنظرية استثنائية وتكميلية، وبرزت هاته النظرية لإيجاد الحل عند قصور المسؤولية على أساس الخطأ في تعويض حالات عدم قدرة المتضرر على إيجاد الخطأ تسنده لمرفق الأمن أو صعوبة عبء إثباته. Abstract : The responsibility of the administration without fault for the police facility is based on risks and is applied in the event of damage resulting from the actions carried out by the security facility using weapons and machines that pose exceptional risks to individuals.
