جريمة التهريب الجمركي وآليات إدارة الجمارك الموريتانية في مكافحتها

الملخص
يهدف هذا المقال إلى إبراز الدور الهام الذي تقوم به الإدارة العامة للجمارك الموريتانية من خلال محاربة وقمع جريمة التهريب الجمركي باعتبارها المعني الأول الذي منحه المشرع الموريتاني ذلك الدور مع تبيين الإطار القانوني لهذه الجريمة من زاوية التشريع الموريتاني أي قانون الجمارك و التنظيمات واللوائح الجمركية الموريتاني وكذلك تبيين أهم الآليات القانونية لمكافحة هذه الجريمة ، وتقييم تلك الآليات، هذا بإتباع المنهج التحليلي مع الاستعانة بالمنهج الوصفي وصولا إلى جملة من الاستنتاجات و التوصيات . Cet article vise à souligner le rôle important joué par l'Administration générale des douanes mauritanienne dans la lutte et la répression du délit de contrebande douanière car c'est le premier sens que le législateur mauritanien a donné à ce rôle, tout en clarifiant le cadre juridique de ce délit du point de vue vue de la législation mauritanienne, c'est-à-dire la loi douanière mauritanienne, la réglementation et la réglementation douanière, ainsi que la clarification des mécanismes juridiques les plus importants pour lutter contre ce crime, et l'évaluation de ces mécanismes, en suivant l'approche analytique avec l'utilisation de l'approche descriptive, débouchant sur un certain nombre de conclusions et de recommandations. This article aims to highlight the important role played by the Mauritanian General Administration of Customs by combating and suppressing the crime of customs smuggling as it is the first meaning that the Mauritanian legislator gave that role, while clarifying the legal framework for this crime from the point of view of the Mauritanian legislation, i.e. the Mauritanian customs law, regulations and customs regulations, as well as clarifying The most important legal mechanisms for combating this crime, and evaluating those mechanisms, by following the analytical approach with the use of the descriptive approach, leading to a number of conclusions and recommendations.
