الأليات القانونية المكرسة لاستغلال العقار الإقتصادي في ظل قانون 23-17

الملخص
مما لا يدع مجالا للشك بأن العقار الإقتصادي يعدّ أحد الرهانات التي يعول عليه في الدول المتطورة لتحقيق الإقلاع الإقتصادي وللرفع من مؤشرات النمو؛ خاصة في ظل تحديات ومؤشرات تراجع عائدات البترول، فالعقار الإقتصادي إذا تم إستغلاله على أحسن وجه من شأنه الإسهام في جلب الثروة وتوفير مناصب الشغل، فهو مجال خصب للإستثمار وقاطرة حقيقية للتنمية الشاملة بشقيها الإقتصادي والإجتماعي وبديلا أمثلا للمحروقات، والجزائر تزخر بمقدرات وموارد واعدة في مجال الإستثمار؛ وهذا ما يؤهل العقار الإقتصادي لأن يتصدر المشهد التنموي، وعلى هذا الأساس سعت السلطات العليا في البلاد لإحاطته بترسانة تشريعية متلاحقة تبرز من خلالها الأليات القانونية لاستغلاله، وعليه يمكن طرح لمعالجة الإشكالية التالية: فيما تتمثل الأليات التي كرّسها القانون رقم 23-17 المحدد لشروط وكيفيات منح العقار الإقتصادي التابع للأملاك الخاصة للدولة الموجه لإنجاز مشاريع استثمارية ؟ االملخص باللغة الإنجليزية: Abstract: There is no doubt that economic real estate is one of the most reliable bets in developed countries to achieve economic take-off and raise growth indicators. Especially in light of the challenges and indicators of declining oil revenues. In fact, economic real estate, if exploited in the best way, would contribute to bringing wealth and providing jobs. It is a fertile field for investment and a real engine for comprehensive development, both economic and social, and an ideal alternative to fuel. Algeria is replete with promising capabilities and resources in the field of investment; This is what qualifies economic real estate to take the lead in the development scene, and on this basis, the highest authorities in the country have sought to surround it with a successive legislative arsenal through which the legal mechanisms for exploiting it emerge. Accordingly, the following problem can be addressed: What are the mechanisms established by Law No. 23-17 of November 15, 2023, which specifies the conditions and modalities for granting economic real estate belonging to the state’s private property intended for the implementation of investment projects?
