التجسس الدبلوماسي في القانون الدولي

الملخص
يشكل الوضع القانوني الخاص الذي يطبق على الدبلوماسيين، الوسيلة في غالب الأحيان لتيسير عملية التجسس، مما يتنافى مع مقتضيات تمتعهم بالحصانات والامتيازات الدبلوماسية المكرسة باتفاقية فيينا للعلاقات الدبلوماسية لعام1961. وتتمثل أهمية هذه الدراسة في أن التجسس الدبلوماسي ظاهرة تمثل أخطر أنواع استعمال الحصانات والامتيازات الدبلوماسية إذا ما قورنت بغيرها من أنواع الجريمة الدبلوماسية كونها تمس أمن الدولة في العمق فتهدد كيانها واستقرارها وسيادتها، مما يقوض في النهاية السلم والأمن الدوليين. ومن هذا المنطلق سعت الدراسة الى تحديد مفهوم التجسس الدبلوماسي حيث نقوم فيها بتوضيح تعريف التجسس الدبلوماسي ومدى شرعيته كما تناولت الدراسة مسألة العوامل التي تساعد على التجسس الدبلوماسي. كما عالجت هذه الدراسة الآثار القانونية المترتبة عن أعمال التجسس التي يرتكبها المبعوثون الدبلوماسيون من خلال آثار ممارسة المبعوث الدبلوماسي للتجسس، في هذا السياق نناقش مسألة قيام المسؤولية الدولية للدولة الموفدة التي يمثلها المبعوث الدبلوماسي الجاسوس. وفي الاخير انتهت الدراسة بنتائج وتوصيات لمعالجة موضوع التجسس الدبلوماسي. The special legal status applied to diplomats is often the means to facilitate the espionage process, which is inconsistent with the requirements of their enjoyment of diplomatic immunities and privileges enshrined in the Vienna Convention on Diplomatic Relations in 1961. The importance of this study is that diplomatic espionage is a phenomenon that represents the most dangerous type of use of diplomatic immunities and privileges compared to other types of diplomatic crimes, because it profoundly affects the security of the State and threatens its entity, its stability and its security. sovereignty, which ultimately undermines international peace and security. From this point of view, the study sought to define the concept of diplomatic espionage, in which we clarify the definition of diplomatic espionage and the extent of its legitimacy, as well as the question of factors that favor espionage diplomatic. This study also addressed the legal consequences arising from acts of espionage committed by diplomatic envoys through the effects of the practice of espionage of the diplomatic envoy. In this context, we discuss the question of establishing the international responsibility of the sending State represented by the diplomatic espionage envoy. Finally, the study concluded with results and recommendations to address the issue of diplomatic espionage.
