علاقة القضاء الدستوري بهيئات الصياغة التشريعية و دورها في تحقيق جودة القانون

الملخص
تعتبر المـبادرة التشريعية ومشاريع القوانين اللبنة الأولى في البنــاء القانونــــــــــــــــــي، فهــــــي المرحلــــــة الأساسية في التشريع، وهـــو الــــذي يجعــــل مــــن السلطـــــــــــة التشريعية والسلطــــة التنفيذية قـــادرين عـــلــــــى ضـــــمان الصياغـــــــــــة التشريعية الجــــــيدة المتضمنة الــــدقـــــة والبساطة والوضــــــــــــــــــوح تكريسا لــــــمبدأ الأمــــــــن القانوني، إضافــــــــــــــة إلى الدور الذي قام به المجلس الدستوري الذي لا يقل أهمية عن الهيئات الأخرى من خلال اجتهاداته التي اهتمت كثيرا بموضوع الصياغــــــــــة، بـــــــــل وأصبح ينافس البرلمـــــــان والحــكــــومـــــــــــــــة أحيانا خاصة في مجال تفسيره للقانون وإعادة صياغته، وهذا دون إهمال الدور الاستشاري لمجـــــــــلس الدولة الـــــــــــذي أثبت جدارته في مجال سلطته الاستشارية على مشاريع القوانين والأوامـــر التي كثيرا ما حرص فيها على الأسلوب الواضح والدقيق مــــــــــــــــن أجل ضمان نص قانوني لا يكتنفه الغموض. Legislative initiative and bills are the first building block in legal construction legislation, which makes the legislature and the Executive capable of ensuring serious legislative formulation with precision, simplicity and clarity in order to uphold the principle of legal security ". in addition to the role played by the Constitutional Council, which is no less important than other bodies through its jurisprudence, which has devoted considerable attention to the subject of drafting, Parliament and the Government have sometimes even competed, especially in the area of interpretation and reformulation of the law. This is without neglecting the advisory role of the Council of State, which has proven its authority in advisory power over bills and orders in which it has often endeavored in a clear and precise manner to ensure an unambiguous legal text.
