الملخص
يكون التقييم التطبيقي لإجراء المثول الفوري على أساس السنوات التي أعتمد فيها القضاء الجزائري على إجراءات المثول الفوري منذ دخوله حيز التطبيق إلى يومنا هذا، حيث أن التطبيق العملي لنظام المثول الفوري هو الوحيد الذي يمكنه تقدير مدى نجاعته، خاصة وأنه تميز باختلاف الآراء حوله من بين مؤيد له ومعارض ومن بين متفائل ومتخوف، إلا أن الرأي الغالب الذي أجمع عليه الفقهاء وممارسي المهنة ورجال الميدان من قضاة ومحامين وحقوقيين أن هذا الإجراء لازالت تشوبه بعض النقائص التشريعية والإجرائية. The practical evaluation of the immediate appearance procedure will be based on the years in which the Algerian judiciary has relied on the immediate appearance procedures since its entry into force until the present day, as the practical application of the immediate appearance system is the only one that can estimate the extent of its effectiveness, especially since it was characterized by differing opinions about it among its supporters. There are those who oppose it, and there are those who are optimistic and apprehensive, but the overwhelming opinion unanimously agreed upon by jurists, practitioners, and field personnel, including judges, lawyers, and jurists, is that this measure is still marred by some legislative and procedural shortcomings.
