الملخص
دفعت الوضعية الكارثية التي آلت اليها المسألة العقارية في الجزائر نتيجة التشريعات القانونية الصادرة خلال الفترة الممتدة 1863-1887، بالإدارة الفرنسية للبحث عن حلول واصلاحات جديدة لتجاوز هذه المشكلة، وبعد محاولات حثيثة ومناقشات مستعجلة بمجلس الشيوخ وكذا النواب؛ تم اصدار قانون 16 فيفري 1897 الذي جاء كمحاولة للتوفيق بين مصلحتين المعمرين من جهة والاهالي من جهة اخرى، غير ان ما جاء به هذا القانون زادة من عمق الهوة و جعل التوفيق بين هذه المصلحة امر مستحيل على أرض الواقع، وهو ما سنحاول معالجته في هذا المقال من خلال تسليط الضوء على جوهر هذ ا القانون وكيفية تطبيقيه واهم النتائج التي اسفر عنها. تهدف هذه الدراسة إلى معرفة مدى نجاعة قانون فيفري 1897 في حل المعضلة العقارية بالجزائر ومعرفة خبياه الحقيقة و ذلك من خلال قراءة تاريخية لما تضمنته المنشورات الفرنسية . The dire situation that the real estate issue in Algeria had reached due to the legal regulations issued during the period 1863-1887 prompted the French administration to search for new solutions and reforms to address this problem. After rigorous attempts and urgent discussions in the Senate and the house of Representatives , the law of February 16, 1897 was enacted. this law was introduced as an attempt to reconcile the long-standing interests of both the centenarians and the local population. However , it deepened the divide and made achieving reconciliation between these interests practically impossible. In this article , we will attempt to address this issue by shedding light on the essence of this law , its application and the most significant outcomes it yielded. This study aims to assess the effectiveness of the February 1897 law in resolving the real estate dilemma in Algeria and uncover its true implication through a historical analysis of the content found in French publications.
