الدور الرقابي للملجس التشريعي الفلسطيني على أعمال السلطة التنفيذية

الملخص
إن الرقابة البرلمانية من أحد الصور الديمقراطية في النظام البرلماني، وخولت المجلس التشريعي الوقوف على حالة ونشاط السلطة التنفيذية، فالسلطة التشريعية هي التي تشرع القوانين وتمثل الشعب الذي قام بانتخابها، ولضمان تنفيذ القوانين على الوجه الذي أقره القانون، تقوم السلطة التشريعية بالرقابة على السلطة التنفيذية نيابة عن الشعب من خلال عدة وسائل وهي السؤال البرلماني ، والتحقيق ،الاستجواب ،وحجب الثقة، وبين القانون الأساسي والنظام الداخلي للمجلس التشريعي آلية وإجراءات كل وسيلة على حدى، ليتسنى لأعضاء المجلس استعمالها بالشكل المطلوب، وقد تؤدي الرقابة البرلمانية إلى حجب الثقة عن الحكومة واستقالتها، او محاسبة الوزير بشكل فردي واستقالته، أو ربما تعديل قانون نافذ. Abstract: Parliamentary oversight is one of the democratic forms in the parliamentary system, and the legislative council is empowered to determine the status and activity of the executive authority, and the legislative authority is the one that legislates laws and represents the people who elected them, and ensures the implementation of laws in the manner approved by law, the legislative authority monitors the executive authority on behalf of the people through several means: parliamentary questioning, investigation, interrogation, and no confidence, and between the Basic Law and the rules of procedure of the legislative council, the mechanism and procedures of each means separately, so that members of the Council can use it in the form Parliamentary oversight may lead to a vote of no confidence in the government and its resignation, or the individual accountability of the minister and resignation, or perhaps the amendment of an existing law.
