حوكمة مرفق التعليم العالي في ظل تفعيل مبدأ الشفافية الإدارية

الملخص

اكتسى موضوع حوكمة مرفق التعليم العالي أهمية بالغة لدى رجال السياسة والقانون، ومجالا واسعا لكتابات الفقهاء والمفكرين باعتباره أسلوب التغيير والإصلاح الإداري والتنظيمي الداعم لسبل عصرنة القطاع، ومواكبة التطورات التي شهدتها جل الجامعات في العالم في ظل تداعيات الحوكمة والتكنولوجيات الحديثة. وسنحاول من خلال دراستنا لهذا الموضوع التطرق للإطار المفاهيمي لعناصر الدراسة والمتعلقة بمفهومي الحوكمة ومبدأ الشفافية الإدارية، وتسليط الضوء على أهم الأطر القانونية والمؤسساتية الداعمة لمبدأ الشفافية الإدارية ، فضلا عن التركيز على التشريعات الناظمة لمبدأ الشفافية الإدارية في الجزائر، مع الإشارة إلى بيان العلاقة بين الشفافية الإدارية بحوكمة مرفق التعليم العالي. وقد توصلنا إلى أن ممارسة الشفافية الإدارية حقق جملة من الآثار الايجابية التي تشكل الأبعاد الحقيقية لحوكمة مرفق التعليم العالي على الرغم من قصور التشريعات الداعمة والمكرسة لمبدأ الشفافية ونظام الحوكمة، وضعف حلقة استخدام التكنولوجيات الرقمية، والوعي بأهمية الشفافية الإدارية. The issue of governance of the higher education facility has gained great importance among politicians and jurists, and has been widely used in the writings of jurists and thinkers, as it is a method of administrative and organizational change and reform that supports ways to modernize the sector and keep pace with the developments witnessed by most universities in the world in light of the repercussions of governance and modern technologies. Through our study of this topic, we will attempt to address the conceptual framework of the elements of the study related to the concepts of governance and the principle of administrative transparency, and to shed light on the most important legal and institutional frameworks that support the principle of administrative transparency, as well as focusing on the legislation regulating the principle of administrative transparency in Algeria, with reference to a statement of the relationship between administrative transparency Governance of higher education facility. We have concluded that the practice of administrative transparency has achieved a number of positive effects that constitute the true dimensions of the governance of a higher education facility, despite the shortcomings of legislation supporting and devoting the principle of transparency and the governance system, the weakness of the use of digital technologies, and awareness of the importance of administrative transparency.
