الملخص
ملخص: إن نقل وترحيل السكان من المناطق التي يعيشون فيها هي سمة مشتركة في جميع النزاعات المسلحة الدولية وغير الدولية على حد سواء. ولكن المشكلة هي عندما يتم ترحيلهم وإبعادهم قسرا باستخدام القوة المادية المباشرة، وهي إحدى الركائز الأساسية لسياسة الاحتلال الإسرائيلي في حق أبناء الشعب الفلسطيني، فاعتبرت سياسة الإبعاد والتهجير القسري جريمة دولية مخالفة لأحكام وقواعد القانون الدولي، وانتهاكاً صارخا للمواثيق الدولية ولشرعية حقوق الإنسان. توفر هذه الورقة، إطاراً مفاهيمياً لجريمة الإبعاد والتهجير القسري، ومرجعية لفهم ما يحدث في حق الشعب الفلسطيني من ترحيل تعسفي ونقل قسري تقوم به قوات الاحتلال الإسرائيلي يوميا. بالإضافة إلى البحث عن الوصف القانوني للسياسات الإسرائيلية المنتهجة، وما إذا كانت مختلف القواعد الدولية قد عُنيت بتوفير الحماية للسكان المدنيين المبعدين والمهجرين قسراً من أراضيهم أم تجردت منها. Abstract: The transfer and deportation of populations from the areas in which they live is a common feature of all armed conflicts, both international and non-international. But the problem is when they are forcibly deported and deported using direct physical force, which is one of the basic pillars of the Israeli occupation policy against the Palestinian people. The policy of deportation and forced displacement was considered an international crime in violation of the provisions and rules of international law, and a blatant violation of international covenants and the legitimacy of human rights. This paper provides a conceptual framework for the crime of deportation and forced displacement, and a reference for understanding what is happening to the Palestinian people in terms of arbitrary deportation and forced transfer carried out by the Israeli occupation forces on a daily basis. In addition to searching for the legal description of the Israeli policies adopted, and whether the various international rules were concerned with providing protection to the civilian population who were deported and forcibly displaced from their lands, or were stripped of it.
