مبدأ الأمن القانوني بين المقومات والمعوقات

الملخص
تهدف دراسة موضوع مبدأ الأمن القانوني بين المقومات والمعوقات إلى الإحاطة بمفهوم هذا المبدأ من خلال تعريفه وتحديد قيمته الدستورية وإبراز المقومات الأساسية التي يقوم عليها ، وبيان السبل التي من شأنها تجاوز المعوقات التي تعيق تجسيد هذا المبدأ. وتوصلت الدراسةإلى أنه لا يوجد إجماع فقهي حول تعريف المبدأ ولاحتى إجماع بين الدول حول قيمته الدستورية، فبعضها تنص عليه كمبدأ دستوري في متن دساتيرها والبعض الآخر يكتفي بالنص على مقوماته دون النص عليه صراحة ، إلا أنه يمكن تعريف المبدأ من خلال مقوماته التي يكاد يجمع عليها الفقه لاسيما منها الوصول إلى القانون ووضوحه واستقراره ، وأنه ولتجاوز معوقات هذا المبدأ لاسيما التضخم والفراغ التشريعيين ، لابد من تبني مجموعة من المبادئ والآليات كاحترام القانون وجودة الصياغة التشريعية والأمن القضائي.
