المسؤولية الإدارية للشخص االمعنوي العام و انتفائها

الملخص
تعد العلاقة السببية ركنا أساسيا و مقوما لا غنى عنه لانعقاد المسؤولية الإدارية وقيامها، سواء كانت مسؤولية خطئية أو مسؤولية غير خطئية، و تبعا لذلك فإن انتفائها انتفاء للمسؤولية، و حتى تسأل الإدارة وتلزم بدفع التعويض، يجب على المضرور أن يثبت من جهة وجود علاقة سببية بين الفعل أو النشاط الإداري وبين الضرر الذي أصابه، ومن جهة أخرى أن يسند هذا الضرر إلى شخص إداري معنوي عام محدد بدقة، مع عدم توافر سبب من أسباب الإعفاء من المسؤولية . Abstract : The causal link remains the main element and the principal evaluator to attest the existence or not of an administrative responsibility, and its establishment. Whether it is a responsibility for fault or a responsibility without fault, therefore the lack of this causal link will amount to the negation of liability so that, in order for any administration to be required to repair the damage and pay compensation, the plaintiff must prove the existence of the causal link between the facts or the administrative activity and the damage suffered by him. In addition, he must prove that these damages are the responsibility of the public administrative legal person by designating it with precision and without any reason discharging it from liability.
