منهجية البحث في أصول الفقه Methodology Of Research In Usul Al-fiqh

الملخص
يهدف الباحث إلى إظهار أن علم أصول الفقه ليس موضوعاً ومادة فقط، بل هو منهج أيضاً. وأن أهمية هذا الموضوع تكمن في أنه وسيلة ومنهج للوصول للأحكام الشّرعيّة. وجاء إيضاح هذا الأمرفي ظل إطار عام هو "منهجية البحث في أصول الفقه"، والذي استعرضه من خلال خمسة مباحث: الأول لبيان أسبقية علماء أصول الفقه في إقرار المناهج، والثاني لبيان حقيقة مناهج البحث وارتباطها بأصول الفقه، والثالث لبيان منهج البحث من خلال التروي لإصدار الحكم، والرابع لبيان منهج "الأصوليين" بين البحث التجريبي والبحث التقليدي، والخامس لبيان مناهج الكتابة في أصول الفقه بين البحث الاستنباطي والاستقرائي. وخلص البحث لنتائج أهمها أسبقية علمائنافي وضع مناهج العلوم وخاصّة في علم أصول الفقه. The researcher aims to demonstrate that the science of Usul al-Fiqh (Principles of Islamic Jurisprudence) is not just a subject matter but also a methodology, and its importance lies in being a means and methodology for reaching Sharia rulings. This is elucidated within the general framework of "Research Methodology in Usul al-Fiqh," presented through five sections: the first highlights the precedence of Usuli scholars in establishing methodologies, the second discusses the nature of research methodologies and their connection to Usul al-Fiqh, the third discusses the research methodology through analysis for issuing rulings, the fourth discusses the methodology of Usulis between experimental research and traditional research, and the fifth discusses writing methodologies in Usul al-Fiqh between deductive and inductive research. The research concludes with key findings, including the precedence of scholars in establishing methodologies in sciences, especially in the field of Usul al-Fiqh.
