الملخص

مما لا شك فيه ان الاعلام بشكل عام يلعب دورا هاما في حياة المجتمع , لما له من تأثير مباشر و فعال في سلوك المتلقي و ذلك في مختلف مجالات الحياة اليومية , سواء كانت سياسية او اقتصادية او اجتماعية . ومن بين اهم وسائل الاعلام الحديثة التي تعد الاكثر تأثيرا في حياة الافراد هو الاعلام السمعي البصري .و تكمن اهميته في انه يستخدم اجهزة متعددة للتواصل . ونظرا للتحول الذي عرفته الجزائر في اطار الانفتاح السياسي و الاقتصادي ,كان لزاما على الدولة فسح مجال التنافس في المجال الاعلامي في القطاع الخاص كضرورة في مواجهة تطور السوق بعدما كان حكرا لعقود من الزمن على القطاع العمومي . كان لابد من استحداث الية جديدة تضمن ارساء قواعد المنافسة الحرة في القطاع الاعلامي حيث اوكلت هذه المهمة الى سلطة الضبط السمعي البصري مع اعطائها الصلاحيات الكافية لضمان حرية الاعلام بكل شفافية و ارساء قواعد المنافسة الحرة بعيدا عن اي توجيهات من قبل السلطات السياسية في الدولة . سنحاول من خلال هذه الدراسة تسليط الضوء على الاليات القانونية المنظمة للنشاط الاعلامي السمعي البصري الرقمي في ظل التشريع الجزائري . There is no doubt that the media in general plays an important role in the life of society, because of its direct and effective impact on the behavior of the recipient and that in various areas of daily life, whether political, economic or social. One of the most influential modern media in the lives of individuals is audiovisual media. Its importance is that it uses multiple devices to communicate. Given the transformation of Algeria in the context of political and economic openness, it was necessary for the state to allow competition in the field of media in the private sector as a necessity in the face of the development of the market, which had been a monopoly for decades on the public sector. A new mechanism was necessary to ensure the establishment of free competition rules in the media sector. This task was entrusted to the audiovisual control authority with sufficient powers to ensure freedom of the media in all transparency and to establish free competition rules away from any directives by the political authorities in the country. In this study, we will try to shed light on the legal mechanisms governing digital audiovisual media activity under Algerian legislation.
