الملخص
تعد الصفقات العمومية إحدى أهم العقود الإدارية التي تعتمد عليها الدولة لتنفيذ جزء معتبر من نفقاتها، ونظرا لارتباطها الوثيق بالمال العام أولاها المشرع الجزائري حماية خاصة من خلال إخضاعها لعدة أوجه من الرقابة، من بينها الرقابة المالية القبلية التي يضطلع بها جهازين تابعين إلى الوزير المكلف بالمالية وهما المراقب الميزانياتي والمحاسب العمومي، حيث تهدف هذه الأخيرة إلى مطابقة اجراءات إبرام وتنفيذ الصفقات العمومية لقواعد الإنفاق المقررة قانونا، مما يحول دون إهدار المال العام وسوء إستخدامه. Public deals are one of the most important administrative contracts that the state relies on to carry out a significant portion of its expenditures , Given their close connection to public funds, the Algerian legislator has given them special protection by subjecting them to several aspects of oversight, including tribal financial oversight carried out by two agencies affiliated with the Minister in charge of Finance namely The budget controller and the public accountant, the latter aims to conform the procedures for concluding and implementing public transactions to the legally established spending rules, which prevents the waste and misuse of public funds.
