الملخص

ملخص: إن معرفة استمداد علم أصول الفقه من العلوم الأخرى من الأهمية بمكان، ومثلها وربما تزيد عليها معرفة الاستمداد التفصيلي لمباحثه؛ إذ هي معيار صدق الاستمداد، وهي الأثر لتجليه في العلم، ولذلك جاء هذا البحث لدراسة الاستمداد الأصولي في باب الأحكام الشرعية. وجاء هذا البحث لتطبيق أحكام الاستمداد على مبحث الحكم الشرعي، مسلطا الضوء على الحكم الشرعي من حيث أهميته، وتدوينه، وموقعه من المنظومة الأصولية، معتمدا على المنهج الوصفي التحليلي وصولا إلى تحقيق أهداف البحث والتي من أهمها: تفعيل المادة التأصيلية للاستمداد على المباحث الأصولية، والوقوف على فلسفة الحكم الشرعي في المباحث الأصولية. Abstract: The knowledge of the derivation of the knowledge of the origins of Fiqh from other knowledge is of great importance, as is, perhaps even more so, the knowledge of the detailed derivation of its research, as it is the criterion of the truthfulness of the derivation and the impact of its manifestation in knowledge. This research came to apply the provisions of derivation to the research of legal governance, highlighting the importance of legal governance, its codification, and its position in the fundamentalist system. It relied on the descriptive analytical approach to achieve the research objectives, the most important of which were activating the root material of derivation in fundamentalist detectives and standing on the philosophy of Sharia governance in fundamentalist detectives.
