الملخص
تعتبر الفروق الأصولية من أهم الموضوعات المطروقة في علم أصول الفقه في هذا العصر؛ حيث كتبت فيها رسائل علمية وبحوث أكاديمية شملت جانبيها التأصيلي والتطبيقي، وموضوع هذه المقالة عبارة عن رسالة مخطوطة تناولت بمسألة جزئية متعلقة بالجانب التطبيقي لفن الفروق الأصولية، وجاءت جوابا من الشيخ علي الميلي المالكي على استشكال العلامة يحيى الشاوي المالكي للفرق بين السبب والشرط، وقد تم ضبط نص الجواب والتعليق عليه مع الترجمة للمصنف وبيان مصادره وذكر أهم النتائج المتوصل عليها. Fundamental differences are considered one of the most important topics discussed in the science of jurisprudence in this era. Where I wrote scientific theses and academic research that included both its original and applied aspects, and the subject of this article is a manuscript letter that dealt with a partial issue related to the applied side of the art of fundamentalist differences, and it came as an answer from Sheikh Ali Al-Mili Al-Maliki to the scholar Yahya Al-Shawi Al-Maliki’s form of the difference between reason and condition, and it has been seized The text of the answer and commentary on it, along with the translation of the workbook, indicating its sources, and mentioning the most important results reached.
