الملخص

تعد جريمة العدوان واحدة من أخطر الجرائم الدولية وأشدها فظاعة، ومع ذلك استمرت البشرية في المعاناة من تفلت المجرمين من العقوبة بسبب غياب تعريف واضح لهذه الجريمة. استغرق وضع تعريف لجريمة العدوان أكثر من 50 عامًا بعد الحرب العالمية الثانية، تحديدًا منذ إرساء نظام المحكمة الجنائية الدولية، حيث أقر نظام المحكمة الجنائية الدولية اختصاصه لمعاقبة مرتكبي جرائم الحرب والجرائم ضد الإنسانية وجرائم الإبادة الجماعية، لكنه لم يشمل جريمة العدوان ضمن اختصاصه حتى تم الاتفاق على تعريفها وإجراءات معقدة لتفعيل اختصاص المحكمة، ليتحقق هذا الإنجاز بعد مرور سبع سنوات من مؤتمر كامبالا عام 2010، بعد اتفاق غالبية الدول الأطراف، سنبين من خلال هذه الدراسة مدى الدور الذي لعبه إدراج وتعريف جريمة العدوان في نظام روما الأساسي في تفعيل اختصاص المحكمة بشأن هذه الجريمة. The crime of aggression is regarded as one of the gravest and heinous international crimes; nevertheless, humanity has continued to suffer as criminals evade punishment due to the lack of a clear definition for this crime. It took more than 50 years to establish a definition for the crime of aggression after World War II, specifically after the creation of the International Criminal Court (ICC). While war crimes, crimes against humanity, and genocide found a clear path to justice through the ICC, The crime of aggression remained elusive for the ICC, lacking a definition and facing complicated activation processes in the Court's jurisdiction. This achievement was finally realised after seven years at the Kampala Conference in 2010 when the majority of State Parties reached an agreement to activate the ICC's jurisdiction over the crime. This study delves into the crucial role played by the inclusion and defined crime of aggression within the Rome Statute's framework, shedding light on how these elements activate the Court's jurisdiction over this critical offense.
