النظر النقدي والوظيفي للدليل في الدرس الأصولي "the Critical And Functional View Of "dalil" In "usul Alfik'h"

الملخص
يهدف المقال إلى تبيان المنحى النقدي للدليل عند الأصوليين تأصيلاً وتنزيلاً، ومجالات استثماره داخلياً وخارجياً، وذلك بالتنصيص على أهم الوظائف المنهجية والعملية للدليل في الفكر الأصولي، وآفاق استثماره، وتقاطعاته مع العلوم المجاورة. وقد تطرق البحث إلى مفهوم الدليل، وأقسامه، ومراتب حجيته عند الأصوليين، وسعى إلى إبراز مركزية الاستدلال عند علماء الأصول، والتأكيد على أن المعارف عندهم برهانية، لا تؤخذ مسلمة إلا بعد مراحل نقدية وتمحيصية من زوايا نظرية وعملية، كما هو واضح في كتبهم المقسمة بين طريقتي الفقهاء والمتكلمين. Abstract: The article aims to clarify the critical approach of the guide for fundamentalists, both rooted and downloaded, and the areas of its internal and external investment, by quoting the most important methodological and practical functions of the guide in fundamentalist thought and the prospects for its investment and its intersections with neighboring sciences. The research touched on the concept of evidence, its divisions, and the levels of its authority for the fundamentalists, and sought to highlight the centrality of inference among the scholars of assets and to emphasize that knowledge for them is demonstrative and is not taken for granted until after critical and scrutiny stages from theoretical and practical angles, as is evident in their books divided between the two methods of jurists and theologians.
