قضاة الدولة الزيانية (أصنافهم ،معايير اختيارهم ودورهم في الحياة الاجتماعية)

الملخص

يعتبر منصب القضاء من المناصب السامية في الدولة الزيانية خاصة وان هذا المنصب يساهم في تسير شؤون العامة والخاصة من خلال الاهتمام بالفصل في النزاعات وإيجاد الحلول المناسبة للمشاكل التي تزعزع استقرار وطمأنينة الدولة والرعية. ونظرا لحساسية منصب القاضي وأهميته بالنسبة للدولة الزيانية والمجتمع فقد اهتم السلاطين الزيانين بهذا المنصب وحرصوا على الرفع من مكانة القاضي ووضعوا شروط ومعايير دقيقة من اجل تولي المنصب، بحيث لا يمكن لأي شخص أن يكون قاضيا إلا بعد مروره على اختبارات تقوم إمكانياته العلمية قدراته سلوكه وصفاته. وقد عرف الجهاز القضائي الزياني أصناف ومراتب عديدة للقضاة لكل مرتبة أو صنف واجبات وصلاحيات خاصة به، كما كشف لنا التاريخ الزياني عن أشهر قضاة الدولة الزيانية ساهموا في الحفاظ على استقرار المجتمع الزياني. ومن هذا المنطلق فان هذه الدراسة تهدف إلى إعطاء نبذة عامة عن الجهاز القضائي الزياني(تعريف القضاء، الخطط التابعة للجهاز القضائي الزياني) بالإضافة إلى ذكر مراتب وأصناف القضاة ومعايير اختيارهم عند الزيانيين والتطرق إلى أشهر قضاة الدولة الزيانية وإسهامهم في التسيير والحفاظ على المصالح الخاصة والعامة للمجتمع الزياني وللدولة الزيانية. The judiciary position is considered one of the supreme positions in the Zayani stateespecially since the role of this position is to manage the public and private affairs of the state and society, This is done through Adjudication of disputes and Resolve discounts, and finding appropriate solutions to problems that threaten the stability and tranquility of the state and the People. Given the sensitivity of the judge's status and his importance to the state and Zayani society, the Zayani sultans took care of this position and were keen to raise the status of the judge and set specific conditions and criteria for assuming the position. So that no person can be a judge except after being evaluated based on his scientific capabilities, capabilities, behavior and attributes.The Zayani judicial system has known many categories and ranks of judges, each rank or category has its own duties and powers, and the Zayani history revealed to us the most famous judges of the Zayani state who contributed to maintaining the stability of the Zayani society. From this point of view, this study aims to give a general overview of the judicial system (definition of the judiciary, plans of the Zayani judicial system),In addition to mentioning the ranks and categories of judges in the Zayani state, and presenting the conditions and criteria for their selection,In addition to mentioning the most famous judges of the Zayani state and their contribution to managing and preserving the private and public interests of the Zayani community and the Zayani state.
