الملخص

الملخص يهدف المنهج العلمي في العلوم الإنسانية لتوفير المعلومات الكافية لتفسير الظاهرة موضع الدراسة حيث يتطلب ذلك تقديم تحليل لطبيعة العناصر المختلفة التي تكون الظاهرة والعلاقات التي تحكمها و تأثير هذه العوامل على الظاهرة بصورة كلية بإتباع معايير واستخدام إطار مرجعي تفسيري للمعارف للتوقع والتنبؤ والبحث عن التعميمات بالملاحظة المنظمة غير العشوائية للواقع الاجتماعي. وبالخصوص حول الظاهرة الإجرامية و تفسير السلوك الإجرامي التي تساعد المشرع الجنائي أثناء صياغته للقاعدة التجريمية ، لتكون النصوص التجريمية مبدنية على أسس علمية وذات فعالية ،خصوصا بعد تطور العلوم الإجرام و الاجتماع الجنائي و الإحصاء الجنائي . الكلمات الافتتاحية:المنهج العلمي،المشرع الجنائي ،القاعدة التجريمية ،علوم الإجرام ، الظاهرة الإجرامية ،الخطورة الإجرامية Abstract: The scientific method in the human sciences aims to provide sufficient information to explain the phenomenon under study, as this requires providing an analysis of the nature of the various elements that make up the phenomenon and the relationships that govern it and the impact of these factors on the phenomenon in a comprehensive manner by following standards and using an explanatory frame of reference for knowledge to anticipate, predict and search for generalizations by unstructured observation The randomness of social reality. In particular about the criminal phenomenon and the interpretation of criminal behavior that helps the criminal legislator during his formulation of the criminal rule, so that the criminal texts are based on scientific and effective foundations, especially after the development of criminology, criminal sociology and criminal statistics.
