أحكام ضمان صلاحية المبيع للعمل مدة معينة في القانون المدني الجزائري والفقه الإسلامي -دراسة مقارنة-

الملخص
يعتبر ضمان صلاحية المبيع للعمل مدة معينة من أهم الضمانات الأكثر وقوعا في عقود البيع التي تنصب على الأجهزة والآلات الدقيقة، كما في بيوع السيارات والآلات الميكانيكية والأجهزة الالكترونية بمختلف أنواعها، وهو ما حدا بالمشرع الجزائري كغيره من التشريعات المقارنة إلى تنظيم أحكام هذا الضمان، حماية منه لحق المشتري في مواجهة هذه السلع التي تتميز بسرعة التعرض للخلل والعطل، ورغبة منه في تحقيق الاستقرار في المعاملات المالية، وزرع الثقة في التبادل التجاري. وعليه، تسعى هذه الدراسة إلى بيان أحكام ضمان صلاحية المبيع للعمل مدة معينة وفقا لنصوص القانون المدني الجزائري، كما تتناول الكيفية التي عالج بها الفقه الإسلامي أحكام هذا الضمان، ومقارنتها مع أحكام القانون المدني. Accordingly, this study seeks to explain the provisions of guaranteeing the authority to sell to work for a certain period in accordance with the provisions of the Algerian Civil Law, as well as how the Islamic jurisprudence dealt with the provisions of this guarantee, and compare them with the provisions of the civil law.
