الحماية الشرعية والقانونية للأرضي ذات الوجهة الفلاحية

الملخص

بعد الاعتداءات التي تعرض لها العقار الفلاحي والتي لازال يتعرض لها من تغير لوجهته وجعله وعاء للعقارات الصناعية والسكنية سن المشرع الجزائري جملة من القوانين والتعليمات التي من شأنها أن توفر الحماية لهذه الثروة الطبيعة التي تتطلب حماية وعناية خاصة، صحيح أن العقار الفلاحي أصناف وأنواع إلا أن المشرع لم يفرق بين أرض مرتفعة الخصوبة وأرض متوسطة الخصوبة أو أرض ملك للدولة أو أرض ملك للخواص إذ العقار الفلاحي يبقى فلاحي ويحاج إلى حماية، ومن خلال البحث تبين أيضا أن الفقه الإسلامي هو الآخر قد كان سباقا لعلاج هذه الظاهرة وأوجد طرقا لحماية هذه الثروة الطبيعية التي تؤمن غذاء الناس وتظم استمرارهم بشكل طبيعي.
