الملخص
هذه دراسة لتعقُّبات في الأقوال الفقهية، اخترت منها تعقيب الإمام عبد الباقي الزُّرقاني على الإمام عبد الرَّحمن الأجهوري، في شرح مختصر خليل، وقد جمعتها من شرح الزُّرقاني على مختصر خليل، وهو مطبوع ومعه حاشية البناني، ثمَّ وثَّقت أقوال عبد الرحمن الأجهوري من حاشيته على مختصر خليل -وهي مخطوطة-، وذلك للتَّأكد من صحَّة ما عزاه، وتهدف الدِّراسة إلى بيان الحقّ في المسائل التي تعقَّب فيها الزُّرقاني على الأجهوري، وأنَّ المخطئ يبيَّن خطؤه نصحًا له ولمن اتَّبعه، من غير انتقاص لفضله، كما أنَّ للفقه الإسلامي مكانة عالية، وأنّه علم حيويٌّ لا يقبل الجمود والتَّعصب، فالواجب اتِّباع الحقِّ والرَّد إلى الشّرع، وقد توصلت بعد البحث إلى أنَّ عبد الرَّحمن الأجهوري وعبد الباقي الزُّرقاني فقيهان لهما باع في علم الفقه، وشرحهما لمختصر خليل مفيدان، وقد استفاد الزُّرقاني من عبد الرحمن الأجهوري كثيرا، ووافقه في مسائل كثيرة، كما التزام الزرقاني بالموضوعية في تعقُّبه مع حسن الأدب فيه Abstract: This study is for tracking sayings of jurisprudence, I chose from it the comments of the imam ABDELBAKI Azarkani on the the imam ABDERHAMAN Aljhouri, about the explanation Khalil, and I gather it from the explanation of AZARKANI on summary KHALIL. It was printed within notes of BOUNANI, then I authentify the quotations and sayings of ABDERHMAN Al-Ajhouri basing on the summary of Khalil and this was manuscript. This was to be sure that what was attributed by AZARKANI to him. Also the study aims to clarify the rightness on the subjects that Alzarkani comments on ALAJHOURI, then who is wrong should corrected by the intention of advise and for whom follow this mistake without underestimating his high position, nevertheless the Islamic jurisprudence has high position, and vital study that is not static also don’t accept extremism, then rightness should be follow and the principle of chariaa have to be the reference. After the research I conclude that ABDERHMAN AL-AJHOURI and ABDELBAKI Azarkani are tow big masters of jurisprudence, and their summary of KHALIL is very important full of benefits. AZRKANI benefits from Abderhman AL-JHOURI so much and he share the same opinion upon many questions, also AZARKANI was objective on his comments with respectful way.
