نصوص أصولية لابن مرزوق الحفيد في مباحث أدلة الأحكام الشرعية Fundamental Texts Of Ibn Marzouq Al-hafeed In The Investigations Of The Evidence Of Legal Rulings

الملخص
ملخص: يهدف البحث إلى الكشف عن الجانب الأصوليِّ في الأعمال العلميَّة للإمام ابنِ مرزوق الحفيد أحدِ أعلام المالكيَّة بتلمسانَ، والَّذي وصفه غير واحد بالأصوليِّ. فما مدى عنايةِ ابن مرزوق بمباحث أصول الفقه وما هي اختياراتُه في مباحث أدلَّة الأحكام؟ عمِلتُ على جمعِ نصوص ابن مرزوق الأصوليَّة في مباحث الأدلَّة من خلال كتبه وفتاويه؛ وتنسيقِها ثم دراستِها والتَّعليقِ عليها مع مقارنة اختياراته بآراء غيره من الأصوليِّين، وقد سلكتُ في الدِّراسة المنهجَ الوصفيَّ للتَّعريف بابن مرزوق الحفيد وبيان مكانته العلميَّة وعنايته بأصول الفقه، أما في دراسة النُّصوص الأصوليَّة فسلكتُ المنهجَ التَّحليليَّ. مِن أظهر النَّتائج المُتوصَّل إليها عنايةُ ابن مرزوق الحفيد بذكر المباحث الأصوليَّة والتَّنويهِ بمسائل علم الأصول في كتبه وفتاويه، وبروزُ مَلكتِه الأصوليَّة ومَتانتها -تقعيدا وتفريعا-، أما اختيارات ابنِ مرزوق الحفيد في مباحث أدلَّة الأحكام فجاءت متوافقة -في الجملة- مع مذهب جمهور الأصوليين من المالكية وغيرهم. الكلمات المفتاحية: ابن مرزوق الحفيد؛ مباحث الأدلَّة؛ أصول الفقه؛ اختيارات؛ نصوص أصوليَّة. Abstract: The research aims to reveal the fundamentalist aspect of the scientific work of Imam Ibn Marzuq, grandson of one of the most prominent Malikis of Tlemcen, described by more than one fundamentalist. What is the extent of Ibn Marzuq's interest in investigating the foundations of jurisprudence, and what are his choices in investigating the proof of judgements? We worked on collecting Ibn Marzuq's fundamentalist texts in the investigation of evidence through his books and fatwas. And to coordinate it, then to study and comment on it, while comparing his choices with the opinions of other fundamentalists. In the study, we followed the descriptive approach to present Ibn Marzuq the grandson and explain his scientific position and his concern for the fundamental principles of science. In the study of the fundamentalist texts, we followed the analytical approach. According to the results obtained, the attention of Ibn Marzuq the Grandson to the mention of fundamentalist investigations and the mention of basic science issues in its books and fatwas, and the emergence of its fundamentalist faculty and strength. As for Ibn Marzuq the Grandson choices in the investigations of the proof of judgements, they were in general in line with the doctrine of the majority of Maliki and other fundamentalists.
