حرية التعبير والصحافة في الجزائر بين اكراهات التشريع ومتطلبات الواقع من 1962/2022.

الملخص
مرت حرية التعبير والصحافة في الجزائر بالعديد من المراحل منذ الاستقلال،وكانت كل مرحلة تتميز بخصائص وظروف معينة جعلت ممارسة مهنة الاعلام محل تجاذبات كبيرة بين رغبة المهنيين في تشريعات وتأطير يسمح بالحرية،وبظروف ملائمة حتى يتمكنوا من تجسيد الحق في الاعلام،وبين سلطة كانت دائما تعمل على التاخر والتماطل في تنظيم المهنة من خلال تشريعات بعيدة عن الواقع معظم موادها لم تطبق،وبين عراقيل وتضييقات جعلت الاعلام في الجزائر يتأخر كثيرا بالمقارنة مع الكثير من التجارب. وأمام تبني تشريعات اعلامية بعد كل أزمة تمر بها الجزائر،يتساءل الأكادميين والخبراء عن أسس هذه التشريعات في ظل انعدام تقييم حقيقي للتجارب السابقة،وهو ما دفعنا للقيام بهذه الدراسة لضبط الاختلالات،والوصول نتائج من شانها المساهمة في ارساء تشريعات تراعي الممارسة والتأطير. Freedom of expression and press in Algeria has gone through several stages since independence. Each stage has been distinguished by special characteristics and circumstances that have made the media profession a major focus between the desire of professionals to establish laws and regulations that frame both this freedom and the appropriate conjunctions to realize the right to information. And between an authority that still struggles to organize the profession through laws so far from reality that most of its articles have never been applied. Also between obstacles and restrictions that have greatly delayed the media in Algeria compared to many other experiences. Also, the adoption of media legislation after each crisis that Algeria has experienced, has pushed academics and experts to question the basis of laws in the context of a real non-evaluation of previous experiences. This has prompted us to carry out this study in order to remedy these inconsistencies and achieve results that can contribute to the establishment of laws that take into consideration the practice and the framework.
