المعاملات المالية في جائحة كورونا

الملخص
الملخص: إن حاجة الناس إلى المعاملات المالية لا تقل أهمية عن حاجتهم إلى الغذاء والكساء، ويتم تحصيل هذه الحاجات بانتظام في الظروف الملائمة من الأمن والعافية والرخاء مما يحقق نوعا من الاستقرار ويحصّل المنافع والمصالح لكل من الأطراف المتعاقدين. ولكن قد ينزل بالناس من الأحوال ــ كالحروب، والمجاعة، والأوبئة ــ ما يخل بهذا النظام فتضطرب المعاملات المالية وتتعطل المصالح. ومن هذه النوازل التي حلّت بالناس ما يسمى بجائحة كورونا التي غزت العالم فتعطلت كثير من المعاملات المالية. فترتب على ذلك أحكام استثنائية في بعض المعاملات فرضتها هذه الجائحة العامة. والمقال الذي سنقدمه يتضمن النظر في بعض الأحكام الاستثنائية لهذه النوازل مع اقتراح بعض البدائل التي تضمن استمرار المعاملات المالية ولو بنسبة تقل معها الخسائر والأضرار. الكلمات المفتاحية: المعاملات المالية، الجائحة، كورونا، النوازل، البدائل. Abstract: People's need for financial transactions is just as important as their need for food and clothin. These needs are regularly met in favorable conditions of security, wellness and prosperity Thus will lead to achieving a kind of stability and obtaining benefits and interests for each of the contracting parties in these transactions. But it may happen to people in circumstances - such as wars, famine, and epidemics - that disturb this system, and financial transactions may be disturbed and interests disrupted. Among these calamities so-called Corona pandemic that invaded the world and disrupted many activities, including those related to financial transactions. This resulted in exceptional provisions in some transactions imposed by this general pandemic. And the article that we will participate with includes looking at some exceptional provisions for these calamities with suggesting some alternatives that guarantee the continuation of financial transactions, even at a rate that reduces losses and damages.
