أهمية الإخطار الذاتي في تكريس استقلالية المجلس الوطني لحقوق الإنسان

الملخص
تهدف هاته الورقة البحثية في المقام الأوّل إلى المساهمة في نشر وعي حقوقي، و إكساب المهتمّين بهذا الميدان من ممارسين ومناضلين ثقافة حقوقيّة سليمة قائمة على أسس علمية صحيحة، وتحقيقاً لذلك كان من المناسب معالجة موضوع حقوق الإنسان في الجزائر وفق التعديل الدستوري لسنة 2020، ضمن أطر علمية نظرية و تحليلية تزيل الغموض الذي يكتنفه، وتُبرِز من خلاله مختلف الآليات الكفيلة بترقيتها ومدى فاعليتها لتحقيق ذلك، سيّما و أنّ موضوع البحث من المواضيع الجديدة، ولعلّي بذلك أفتح آفاقاً جديدة و بزوايا مُغايِرة للانشغال حول هذا الموضوع. وتوصّلت إلى أنّ السلطة التنفيذية تتحكّم في تحريك الاجراء الاستشاري، إذ لها وكقاعدة عامّة سلطة تقديرية كبيرة في الإخطار، وحتّى ضمن حالات الإخطار الذاتي وهي قليلة قيّدت ممارسة هاته الآلية بشروط وخاصة بموافقتها هي. This research paper aims primarily to contribute to spreading human rights awareness, providing those interested in this field, including practitioners and activists, with a sound human rights culture based on sound scientific foundations, in order to achieve this it was appropriate to address the issue of human rights in Algeria in accordance with the constitutional amendment of 2020, within scientific theoretical and analytical frameworks that remove the ambiguity surrounding it, through it the various mechanisms to promote it and the extent of their effectiveness to achieve this stand out. Especially since the topic of research is one of the new topics, and I hope to open new horizons and different angles of concern about this topic. And it concluded that the executive authority controls the triggering of the advisory procedure, as it has, as a general rule, a great discretion in notification, and even in cases of self-notification, which are few and restricted the exercise of this mechanism on conditions, especially with its consent.
