توظيف أحكام فقه العمران في بعث الطابع العمراني المحلي وديمومة المدن القديمة The Utilization Of The Provisions Of Urban Jurisprudence In Resurrecting The Local Urban Character And Durability Of Ancient Cities

الملخص
تمثل أحكام فقه العمران أحد العناصر المهمة في تشكيل واستمرارية المدينة الاسلامية ، تعالج هذه الورقة الدور الذي لعبته أحكام فقه العمران في تسيير المدن الاسلامية مثل مدينة القصبة وقصور سهل واد مزاب قديما ،كما أشرنا لأهمية أحكام فقه العمران في بقاء وديمومة هاته المدن السابقة الذكر و ذلك بالاعتماد على حالة الحفظ والدراسات التي قامت بوصف النموذجين باعتبارهما قطاعان محفوظان حسب القانون الخاص بالقطاعات المحفوظة، كما كان له دور مهم في ظهور مدن جديدة توفر لساكنتها الحماية من المناخ وفق مبادئ التصميم والبناء التقليدية وباستعمال طرق الحديثة التي لا تتعارض وثقافة المجتمع وفي آخر الورقة بينا التأثير الذي كان لفقه العمران " أحكام الجوار " على القانون المدني الفرنسي لبونابارت من خلال كتابات الفقهاء والمؤرخين قديما وحديثا . Jurisprudence provisions are an important element in the formation and continuity of the Islamic city This paper addresses the role played by the provisions of the jurisprudence of urbanization in the management of Islamic cities such as the city of Kasbah and the palaces of Sahl Wad Mzab, We also referred to the importance of the provisions of urban jurisprudence in the survival and permanence of these above-mentioned cities, relying on the status of conservation and studies that described the two models as sectors preserved in according to the law of the reserved sectors. It also played an important role in the emergence of new cities that provide climate protection for its residents in accordance with the principles of design and traditional construction and using modern methods that do not interfere with the culture of society. In the last section of our research paper, we showed the impact that the jurisprudence of urbanization "neighbourhood provisions" had on the French civil law of Bonaparte through the writings of scholars and historians in the past and in the present.
