التعديل الدستوري لنوفمبر 2020 وفرص ترقية مكانة البرلمان في الجزائر

الملخص
يتضمن إصلاح المؤسسات السياسية كأحد أبعاد عملية الإصلاح الشامل، إحداث التغييرات الضرورية في بنية مؤسسات الحكم بغية إتاحة المجال لتوسيع نطاق مشاركة المواطنين عبرها في تقرير الشأن العام، وإدراج الآليات التي تسمح بمراقبة أدائها وفق مبدأ المسؤولية السياسية. تركز أدبيات الإصلاح المؤسساتي المختلفة على أهمية وأولوية المؤسسة التشريعية في مسار إصلاح مؤسسات الحكم، حيث يعتبر البرلمان منطلق كل مسار إصلاحي، لذا من الضرورة بمكان أن يستهدف الإصلاح أولا تعزيز قدرات المجالس النيابية على الإسهام بقوة في سن التشريعات، وتمكينها من آليات رقابية فعالة في مواجهة الحكومة. من هذا المنطلق يأتي اهتمامنا بمحاولة تحليل أهم أبعاد الإصلاح المؤسساتي في الجزائر من خلال التعديل الدستوري لنوفمبر2020، لبحث فرص ترقية مكانة مؤسسة البرلمان في النظام السياسي القائم. Abstract: Reforming political institutions, as one dimension of the comprehensive reform process, includes making the necessary changes to the structure of governance institutions in order to expand the scope of citizen participation through them in determining public affairs, and incorporating mechanisms that allow monitoring their performance in accordance with the principle of political responsibility. The various literatures of institutional reform focus on the importance and priority of the legislative institution in the path of reforming governance institutions, as the parliament is considered the starting point of any reform path. Therefore, it is necessary to first target the enhancement of the capabilities of parliamentary councils to strongly contribute to legislation and enable them with effective oversight mechanisms to hold the government accountable. Based on this perspective, our interest comes in attempting to analyze the most important dimensions of institutional reform in Algeria through the constitutional amendment of November 2020, in order to explore opportunities to enhance the status of the parliamentary institution in the existing political system.
