الملخص
تعد المدينة البيئة الحضرية التي يعيش فيها الإنسان، وقد أصبحت المدن الجديدة في الوقت الحاضر نموذجا معماريا يقتدى به في التوسع العمراني في مختلف بلدان العالم، حيث تعتبر مركزا حضاريا ونقطة التقاء كل الثقافات، وهي ترتبط ارتباطا وثيقا ومباشرا بالتوسع العمراني ومشكلة تهيئة الإقليم، كما تعد سياسة جديدة لمكافحة الفوضى العمرانية الحالية واختيارا بديلا ووطنيا للحد من الفوضى الراهنة وقطبا لتنظيم التوسع العمراني وتوجيهيه، وهذا ما يسعى اليه المشرع الجزائري من خلال تشريعاته سعيا للتأسيس والتنظيم القانوني الجيد لها، من خلال التحكم الجماعي والأفضل لضمان جمال ونسق النمو العمراني وإعادة التوازن للبنية العمرانية في إطار شبكة حضرية متزنة ومتناسقة، كعنصر من عناصر النظام العام المعاصر، فكيف عالج المشرع الجزائري هذه المسألة ضمن نصوصه القانونية؟ فلابد وأنه كان حريص على الموازنة بين جعل موضوع المدن الجديدة ذو حدين، فعند وصف وتحليل أهم القواعد القانونية الخاصة بالموضوع وجدنا أن المشرع يسعى ليجعل منها أداة لتهيئة الاقليم ، وفي نفس الوقت، وسيلة يرغب من خلالها لخلق تنمية مستدامة، والتي تحتم عليه العمل والسعي أكثر من أجل ضبط القواعد القانوني أكثر كونها الأرضية القاعدية واللبنة الأولى لتواجد وتجسيد أي مخطط تنموي. Abstract The city is the urban environment in which people live, and new cities have become at the present time an architectural model to be followed in urban expansion in various countries of the world, as it is considered a cultural center and a meeting point for all cultures, and it is closely and directly linked to urban expansion and the problem of preparing the region. A new policy to combat the current urban chaos and an alternative and patriotic choice to reduce the current chaos and a pole to regulate and direct urban expansion, and this is what the Algerian legislator seeks through its legislation in an effort to establish and good legal regulation for it, through collective and better control to ensure the beauty and coordination of urban growth and re-balance the urban structure in The framework of a balanced and harmonious urban network, as an element of the contemporary public order, How did the Algerian legislator deal with this issue within its legal texts? When describing and analyzing the most important legal rules related to the issue, we found that the legislator seeks to make it a tool for preparing the region, and at the same time, a means through which he wishes to create sustainable development, which requires him to work and strive More in order to control the legal rules more as it is the base ground and the first building block for the existence and embodiment of any development plan
