نظرات في الإجماع الفقهي في حرمة إذاية العلماء

الملخص
ملخص: يتجلى هدف هذا البحث في الذب عن العلماء العدول، وبيان مرتبتهم في الشريعة، وحماية دين الله -عز وجل- بحماية رموزه؛ لأن الطعن فيهم طعن في دين الله؛ لأنهم نقلته وحماته، فأردنا في هذا المقال معرفة حكم إذاية هؤلاء من الكتاب والسنة والإجماع، وأقوال السلف. وذكرنا أن فضل العلماء منصوص عليه في الكتاب والسنة وإجماع الأمة، وأن إذاية المسلم بجميع أنواع الإذاية محرم، ومن باب أولى الأئمة والعلماء الذين هم خيرة هذه الأمة، وذكرنا أيضا أن سبب عدم ذكر العلماء الإجماع في تحريم إذايتهم؛ لأنها من المعلوم من الضرورة وتحصيل حاصل، وأنه إجماع سكوتي معنوي لا شك فيه قطعا، وذكرنا سبب إذاية بعض الناس لهم هو: دعوى الحرية، والحسد، والجهل، والتحزب، وتآمر أعداء الأمة، وذكرنا الإجماع الفقهي في حرمة إذاية العلماء من الكتاب والسنة والإجماع، ثم ذكرنا أنواع الإذاية التي يتعرضون لها ومنها: السخرية والاستهزاء والهمز واللمز، والسب واللعن والغيبة والنميمة، وتتبع عوراتهم، ومنها أيضا: الاعتداء على الجسد، وحكمها كلها التحريم الشديد. Abstract: The objective of this research is to defend the righteous scholars, clarify their rank in Sharia, and protect the religion of God - the Almighty - by protecting its symbols. Because defaming them is defaming the religion of God; Because it was transmitted by him and his mother-in-law, so in this article we wanted to know the ruling on these people from the Qur’an, Sunnah, consensus, and the sayings of the predecessors. We mentioned that the virtue of the scholars is stipulated in the Book, the Sunnah and the consensus of the nation, and that insulting a Muslim with all kinds of admonitions is forbidden, and a fortiori is the imams and scholars who are the best of this nation. Because it is a well-known fact of necessity and attainment, and that it is a silent and moral consensus that there is no doubt about it. Then we mentioned the types of insults to which they are exposed, including: ridicule, mockery, slander, cursing, cursing, backbiting and gossip, and tracing their faults, including: assault on the body, and its ruling is all severe prohibition.
