تقييم فعاليّة الرّقابة على استغلال الأراضي الفلاحيّة الخاصّة

الملخص
تهدف هذه الورقة البحثيّة إلى تقييم الآليّات التّشريعيّة والمؤسّساتيّة المعتمدة في الرّقابة على استغلال الأراضي الفلاحيّة الخاصّة؛ للوقوف على مدى فعاليّتها في منع الإضرار بالمصلحة العليا للمجتمع وتجسيدها للوظيفة الاجتماعيّة لهذه الأراضي، بما يكفل تنفيذ السّياسة العقاريّة للدّولة في محاربة ظاهرة تعطيل منفعة الأراضي الفلاحيّة والمساهمة في تعزيز الأمن الغذائيّ. وقد توصّلنا إلى نتيجة جوهريّة مفادها أنّ الآليّات المذكورة كفيلة في الواقع بتحقيق الغاية التّشريعيّة من وضعها، شريطة تدعيمها بالنّصوص الكافية، حيث تحتاج من جهة إلى تنظيم مُحكم واستفاضة في ضبط المسائل الجوهريّة المتعلّقة بقيد واجب استغلال الأراضي الفلاحيّة الخاصّة، وتحتاج من جهة أخرى إلى تفعيلها في الواقع حيث لا تزال حبرا على ورق باعتراف السّلطة. This article aims to assess the legislative and institutional mechanisms adopted in the control of the exploitation of private agricultural land; In order to achieve the measure of its effectiveness in preventing damage to the supreme interests of society and its embodiment of the social function of these lands, in accordance with the state real estate policy in combating the phenomenon of disturbance the benefit of agricultural land and contribute to strengthening food security. We have reached a fundamental conclusion, namely that the mechanisms mentioned are capable of achieving the legislative objective of their creation, provided that they are supported by sufficient texts, since they must, on the one hand, control and elaborate on the fundamental issues related to the restriction of the obligation to exploit private agricultural land, and on the other hand, they must be activated in reality where it is still a dead letter, as recognized by the authorities.
