الأحكام العامة لجريمة اختطاف الأشخاص General Provisions For The Crime Of Kidnapping People

الملخص
جريمة الإختطاف جريمة خطيرة تهدد الأشخاص و أمنهم ، و تمتد حتى إلى اسرهم . فيتم ابتزاز المخطوف من قبل الخاطف . اما بالنسبة لددوافع الجاني لإرتكاب الجريمة فهي إما نفسية تصيب المجرم في نفسه فيتعرض لضغوط إما أسرية أو في العمل أو المدرسة أو اقتصادية ، كالبطالة و الفقر و تمتاز جريمة الإختطاف بسرعة التنفيذ و الدقة و الإستمرارية ، و خاصة أنها جريمة مركبة . و لذا تدارك المشرع الجزائري و كباقي التشريعات الأخرى جريمة الإختطاف و أدرجها في قانون العقوبات و خصها بقانون 20-15 المتعلق بالوقاية من الإختطاف و طرق مكافحتها ، كما حدد لها عقوبة ردعية تصل لإلى المؤبد في حالة وفاة المخطوف . Kidnapping is a serious crime that threatens the safety and security of persons and extends even to their families. The family of the kidnapped person is extorted by the kidnapper. As for the motives of the perpetrator, they are either psychological, which affects the criminal himself and puts him under pressure, either family, at work, school or economic, such as unemployment and poverty. The crime of kidnapping is characterized by quick implementation, accuracy and continuity, especially as it is a complex crime. Therefore, the Algerian legislature and like other legislations recognized the seriousness of the crime of kidnapping and included it in the Penal Code, especially in Law 20-15 on the prevention of kidnapping and the methods of combating it. It also prescribed a deterrent penalty of up to life in the event of the death of the abductor.
