الرقابة القضائية على دستورية القوانين وتأثيرها على مبدأ الأمن القانوني

الملخص

إن من أهم المبادئ التي تتبناها دولة القانون،مبدأ السمو الدستوري والذي بموجبه يأخذ النص الدستوري المرتبة العليا في سلم الهرم القانوني للدولة ،وضمانا لهذا السمو، تبنت معظم الدول آلية الرقابة على دستورية القوانين،حتى تضمن بذلك احترام كل التشريعات الداخلية للدولة لهذا المبدأ،و في المقابل ومن الغايات الأسمى للدولة القانونية هو تحقيق الأمن القانوني،الذي يخضع فيه الجميع للقانون،مع وجود ثبات نسبي و استقرار في المراكز القانونية. وتهدف هذه الورقة البحثية إلى التعريف بالرقابة القضائية على دستورية القوانين، وهي رقابة تختص بها المحكمة الدستورية الذي كرسها المؤسس الدستوري في تعديل 2020،وهي مؤسسة دستورية مستحدثة جاءت بديلا عن المجلس الدستوري، وعن مدى تأثير قرارات هذه الأخيرة في فصلها بعدم دستورية نص قانوني، على تلك الحقوق والمراكز القانونية التي تشكلت في ظل هذا النص غير الدستوري ،ومنه على الأمن القانوني في الدولة. Abstract: One of the most important principles adopted by the rule of law is the principle of constitutional supremacy,according to which the constitutional text takes the highest rank in the state's legal hierarchy,In order to ensure this highness, most countries have adopted a mechanism for monitoring the constitutionality of laws,in order to ensure that all domestic legislation of the state respects this principle,on the other hand, one of the highest goals of the legal state is to achieve legal security,In which everyone is subject to the law, with relative stability and stability in legal positions, This research paper aims to introduce the judicial control over the constitutionality of laws,It is the oversight of the Constitutional Court,enshrined by the Constitutional Founder in the 2020 Amendment,It is a new constitutional institution that replaced the Constitutional Council. And the search for the extent of the impact of the decisions of the latter in its dismissal of the unconstitutionality of a legal text, On those rights and legal positions that were formed under this unconstitutional text, Hence the legal security in the state
