الملخص

نظرا لجسامة الأضرار التي قد تتعرض لها عملية تنفيذ البيوع الدولية سواء بالنسبة لوسيلة النقل المتمثلة في السفينة خلال رحلتها البحرية أو بالنسبة للبضاعة المنقولة على متنها، فإن عقد التأمين البحري يعتبر من ضمن أحد أهم عقود المجموعة العقدية الإقتصادية التي تشارك في عملية تنفيذ عملية البيع الدولي للبضائع وضمان تسليم البضاعة في ميناء التفريغ المتفق علية بين البـائع والمشتري، الأمر الذي يفسر الإهتمام التشريعي البالغ بتنظيم أحكامه، لذلك جاءت هذه الدراسة لتسليط الضوء على أحد أهم خصائص هذا العقد وهي طريقة إنقضائه بهدف تعريف المتعاملين الإقتصاديين بها وتوضيحها للمشتغلين في هذا المجال. ABSTRACT: In view of the enormity of the damages that may be exposed to the process of carrying out international sales, whether for the means of transport represented by the ship during its sea voyage or for the goods transported on board, the marine insurance contract is one of the most important contracts of the economic contract group that participates in the process of implementing the international sale of goods And the guarantee of delivery of the goods at the port of discharge agreed upon between the seller and the buyer, which explains the immense legislative importance for organization of its rules. Therefore, this study came to shed light on one of the most important features of this contract, which is the method of its termination with the aim of introducing the economic dealers to it and clarifying it to those working in this field.
