التشريح الجنائي: مقتضياته وإجراءاته

الملخص
أظهرت الاكتشافات العلمية التي عرفتها البشرية ضرورة وضع ضوابط قانونية تحكم استعمالاتها حتى لا يتم استغلالها في الإضرار بالإنسان. وقد شهد الميدان الطبي تطورات عديدة دفعت الدول تسعى إلى الاستفادة منها على المستويين التشريعي والقضائي. ويعد التشريح الجنائي أحد أهم المجالات ذات الارتباط الوثيق بالقانون الجنائي، لذلك فإن التعرف على مقتضياته وضوابطه وإجراءاته كفيل بتوحيد أحكامه في التشريعات المختلفة، خدمة للحقيقة التي يستتبعها تطبيق القانون وتحقيق العدالة. هذا المقال يهدف إلى التعرف على مقتضيات التشريح الجنائي وإجراءاته في القانون الجزائري، مستضيئا في ذلك بأحكام القانون الدولي الذي سعى لتوحيد ذلك. Abstract: The scientific discoveries known to mankind showed the necessity of establishing legal controls that govern their uses so that they are not exploited to harm humans. The medical field has known many developments that made countries seek to benefit from them in the legislative and judicial aspects. Forensic autopsy is one of the most important areas closely related to criminal law, so getting to know its requirements, controls and procedures is enough to unify its provisions in different legislations, in order to serve the truth that entails applying the law and achieving justice. This article seeks to identify the requirements and procedures of criminal autopsy in Algerian law, in light of the provisions of international law, which sought to unify this.
