الملخص

ملخص : اهتمت التشريعات المقارنة بتنظيم مهنة المحاماة ؛نظرا للدور الهام الذي تؤديه هذه المهنة الجليلة على مسرح الحياة القضائية ؛فهدف المحاماة تحقيق العدالة ومساعدة الأفراد على أخذ حقوقهم والذود عن حرياتهم ؛ والمساهمة في تحقيق العدالة ؛فالمحامي عنصر جوهري في استمرار مرفق القضاء . يخضع المحامي في ممارسته لمهنته، للقوانين التي تنظم مهنة المحاماة ؛فضلا عن التزامه بآداب وأخلاقيات ممارسة تلك المهنة السامية ؛إلى جانب الخضوع لأحكام العقد الذي يربطه بالموكل ،وما يترتب عليه من التزامات في ذمة طرفيه ؛ومن ابرز هذه الالتزامات التزام المحامي بالحفاظ على أسرار العميل ،الذي يطلعه على مالم يطلع عليه احد ؛حتى وان كان اقرب الناس إليه ،كل تلك الأسرار وغيرها من الأسرار التي تصل إلى علمه اثناء أو بسبب ممارسة مهنته؛تعد أسرارا مهنية يلتزم المحامي بالحفاظ عليها وعدم افشائها ؛فواجب الالتزام بكتمان السر المهني من الالتزامات السلبية التي تترتب على المحامي الذي من خلاله يمكن قياس مدى نزاهة المهني وأمانته في الحفاظ على الثقة العامة خدمة لصالح العام. Abstract: Comparative legislation has been concerned with regulating the legal profession, given the important role that this venerable profession plays on the stage of judicial life. Contribute to the achievement of justice; the lawyer is an essential element in the continuity of the judiciary. In practicing his profession, the lawyer is subject to the laws regulating the legal profession, in addition to his commitment to the ethics and ethics of practicing that lofty profession, in addition to submitting to the provisions of the contract that binds him to the client, and the consequent obligations of both parties, and the most prominent of these obligations is the lawyer’s obligation to preserve the client’s secrets All those secrets and other secrets that come to his knowledge during or because of the practice of his profession are professional secrets that the lawyer is obligated to preserve and not disclose, so the obligation to keep the professional secret is one of the negative obligations. Which is the consequence of the lawyer through which the extent of professional integrity and honesty can be measured in maintaining public confidence in the interest of the public.
