تحديات البراءات الدوائية على ضوء اتفاقية تريبس.

الملخص
إن الحديث عن تحديات البراءات الدوائية في ضوء اتفاقية تريبس، يقودنا أساسا إلى البحث في الجدالات الاقتصادية بين الدول المتقدمة والدول النامية حول مسألة إبراء الأدوية وفق اتفاقية تريبس، وليس دراسة النظام القانوني للبراءات الدوائية وفق اتفاقية تريبس، حيث أن التحديات التي شهدتها دول العالم في ظل تعزيز نظام تجاري دولي تحت ريادة المنظمة العالمية للتجارة قد ترتب عنه جملة من التأثيرات على مصالح الدول خاصية النامية منها. وتتمثل إشكالية الدراسة المطروحة خلال هذه الورقة البحثية في: ما مدى تأثير نظام الإبراء الدوائي الذي جاءت به اتفاقية تريبس في اقرار نظام قانوني للصناعات الدوائية في ظل التحديات بين اقتصاديات الدول؟. والهدف من هذه الورقة البحثية يتمثل في الوقوف على جدلية الصراع الاقتصادي الدولي حول إبراء الأدوية بموجب اتفاقية تريبس، والتي خلقت جدلا واسعا حول مسألة الوصول للدواء، و ما ترتب عنه جملة من المشاكل خاصة بالنسبة للدول النامية ومدى إمكانية وصولها إلى الدواء، إذ أدى نظام الإبراء الدوائي بموجب اتفاقية تريبس إلى نشوء احتكارات من شأنها فرض سطوة واحتكار الشركات الدوائية المبتكرة للمنتجات الدوائية، والمغالاة في أسعارها، خاصة في ظل أزمة كورونا. وللإجابة عن الإشكالية المطروحة تم الاعتماد على المنهج الوصفي لإعطاء وصف حول الحقائق القانونية للتحديات المفروضة بسبب نظام الإبراء الدوائي، والمنهج التحليلي لتحليل بعض نصوص الاتفاقية. Talking about the challenges of pharmaceutical patents in the light of the TRIPS Agreement, leads us mainly to research the economic debates between developed and developing countries on the issue of acquittal of medicines according to the TRIPS Agreement, and not to study the legal system for pharmaceutical patents according to the TRIPS Agreement, as the challenges that the countries of the world witnessed under the Strengthening an international trading system under the leadership of the World Trade Organization has had a number of effects on the interests of countries, especially developing ones. The problem of the study presented during this research paper is: What is the impact of the pharmaceutical release system brought about by the TRIPS Agreement in approving a legal system for the pharmaceutical industries in light of the challenges between the economies of countries?. The goal of this research paper is to stand on the controversy of the international economic conflict over the release of medicines under the TRIPS Agreement, which created a wide debate on the issue of access to medicine, and the resulting number of problems, especially for developing countries, and the extent of their access to medicine, as the discharge system led Pharmaceutical companies under the TRIPS Agreement lead to the emergence of monopolies that would impose the dominance and monopoly of innovative pharmaceutical companies on pharmaceutical products, and exaggerate their prices, especially in light of the Corona crisis. In order to answer the problem posed, the descriptive approach was used to describe the legal facts of the challenges imposed due to the drug release system, and the analytical approach to analyze some texts of the agreement.
