الخلاف الفقهي والقواعد المؤثرة في تضييقه Jurisprudential Divergence And Its Narrowing Rules

الملخص
يتناول البحث الخلاف الفقهي وأهم القواعد المؤثرة في تقليله والتضييق من دائرته، للتدليل على تشوف الشارع الحكيم والفقهاء المسلمين لتحقيق الائتلاف والحفاظ على الأخوة والوحدة بين المسلمين، وأن مشروعية الخلاف ووصفه بالرحمة والتوسعة لا ينافي وجوب الحرص على الاتفاق والبعد عن الاختلاف وأسبابه ما أمكن. وتوصلت الدراسة إلى مجموعة من النتائج، أبرزها: من الخطأ أن يوصف الخلاف بأنه شر مطلقا دون قيد أو ضابط، ويجدر بالباحثين استقراء نصوص العلماء حول هذا الموضوع، وذلك وفق سياقها الحالي والمقالي، إذ لا يتوقع من مسلم عاقل عالم أن ينكر ما لم ينكره الصحابة مما وقع بينهم من خلاف، بل ولا النبي صلى الله عليه وسلم وقد وقع في حياته. في التراث الإسلامي مجموعة من القواعد - هي حصيلة ما استنبطه العلماء واستقرؤوه من النصوص والأحكام- تعبر عن وجوب الحرص على الاتفاق ورفع الخلاف والتقليل منه ما أمكن. من أهم مقاصد تقليل الخلاف وإن كان سائغا اعتبار المآل وسد ذريعة الفرقة والشقاق؛ فكم من خلاف سائغ تحول إلى خلاف مذموم بسبب الجهل والهوى والتعصب. This research is about jurisprudential divergence and the most important rules that contribute in reducing and narrowing it, proving the will of the great lord and muslim scholars to achieve consensus and preserve fraternity and unity among muslims, and that legitimacy of divergence and describing it as a mercy does not contradicts the necessity to ensure convergence and avoid sources of differences as much as possible. The study has come to a number of results, most notably : It is incorrect to describe divergence absolutely as bad without any constraints, it is recommended for researchers to study the scientists' texts about the subject according to their contexts, a muslim researcher cannot deny divergences that occurred among sahabis and during the prophet's (pbuh) life. A number of rules in the islamic heritage - deducted and derived by scientists from texts and rulings - reflect the necessity to ensure convergence and to avoid and reduce divergence as much as possible. One of the most important purposes of reducing divergence, even when it seems pleasant, is considering the outcomes and blocking the means to division and dissension, as many agreeable divergences have turned out to reprehensible due to ignorance, arrogance and fanaticism.
