الملخص
يعتبر الموثق بصفته ضابطا عموميا احد اهم الاعوان القائمين على توثيق العقود والسندات المثبتة للملكية في ظل نظام الشهر العيني، وشريكا يعول عليه للدفع بعملية تطهير الملكية العقارية سواء في العقارات الخاضعة لاجراء مسح الاراضي او تلك التي لم يصلها هذا الاجراء بعد، وهو ما تهدف هذه الدراسة الى تبيانه من خلال التطرق الى حجم الصلاحيات التطهيرية المخولة للموثق ومدى اعتباره شريكا للخروج بحل لأزمة غموض السندات المثبتة للملكية العقارية بالجزائر. As a Public Officer, the notary is one of the most important agents for the documentation of contracts and bonds proven for ownership. and a reliable partner for the purging of real estate property in either the real estate subject to the cadastral procedure or those not yet reached by this procedure; This study aims to demonstrate by addressing the amount of purging powers conferred on the notary and the extent to which he is considered a partner to come up with a solution to the uncertainty of the proven bonds of real estate ownership in Algeria.
